by Dr. Syed Nazir Gilani: Chief Minister of Indian controlled (occupied) part of Jammu and Kashmir Mehbooba Mufti has turned Maulvi and given a fatwa on the death of eight CRPF personnel killed by Fedayeen at Frestabal in Pampore on Saturday 25 June 2016. The two Lashkar-e-Toiba militants who carried out a fidayeen attack also died. She is rightly aggrieved on the death of CRPF personnel and has condemned the attack.  However her failure not to count the loss of two Muslim youth killed and not to say that the souls of the two dead Muslims may rest in peace, makes her a wicked Maulvi.

 

nazir-gilaniSunday 26 June 2016 Maulvi Mehbooba gave a fatwa and said that the attacks like the one in Pampore on Saturday, in which eight CRPF troopers were killed by militants, were a setback to Islam and defamed Jammu and Kashmir. “This is the month of fasting when people should be seeking forgiveness for past sins. This is the time when we should be making sure not to hurt others. This kind of attack where you are affecting families by snatching their bread earner iscondemnable.”

 

It remains of some satisfaction that she did not issue her fatwa on a Friday when Syed Ali Shah Geelani and Mirwaiz Umar Farooq would have been under house arrest and denied their religious right to offer Friday prayers and associate with other Muslims on a ‘Jummah’. She gave her fatwa on a Sunday.The commandment in Exodus 20:8-11 states that the seventh day of the week, Saturday, is the day which the Lord selected as the day of rest and worship. However, in the New Testament the Christian church began to worship and rest on the first day of the week, Sunday.

 

Sunday fatwa has been consigned to waste bin by the people of Pampore. A complete shutdown was observed in Pampore town and its nearby areas to mourn the death of two Lashkar-e-Toiba militants who carried out a fidayeen attack on a CRPF convoy at Frestabal in Pampore, killing eight troopers and wounding 22 others. Kashmiri Youthprotested against the killing of the militants and clashed with government forces throughout the day.All the Shops and business establishments were closed. Police and CRPF were deployed in Drangbal, Namlabal, Frestabal and Kadlabal areas.

Mehbooba Mufti in her fatwa has said

  1. After laying floral wreath on the coffins carrying the bodies of the troopers, at CRPF Centre, Humhama Mehbooba said that nothing can be achieved by this…. We are only defaming Kashmir and the state by these acts. We also deal a set back to the religion we practice.”
  2. She said her heart goes out to the families of the CRPF men killed in the attack. Violence is unacceptable in any way and for any reason.
  3. Such attacks are desperate attempts by militants to derail the peace and reconciliation process started by the state government.
  4. She urged people to isolate the perpetrators of violence as they have brought immense miseries to the people.
  5. Militants were harming the tourism sector at a time when people from many countries have started arriving. She said such attacks also deprived Jammu and Kashmir from its share of development.
  6. “Today there is atmosphere of development. India is attracting lot of investments in infrastructure development and healthcare but when it comes to Jammu and Kashmir, the investors shy away because of these incidents. The worst sufferers of these attacks are people of Jammu and Kashmir.”

Killing in the month of Ramadan or killing on any day of the year is forbidden for a Muslim and there could be no issue with the universal acceptance that ‘life’ precedes any other human right. One has to grieve the death of eight CRPF personnel if it were a mindless killing of a defenceless human being. These arms bearing Hindu soldiers have entered the Muslim majority State of Jammu and Kashmir with an instinct to kill a Muslim and while alive continue to disgrace him.

CRPF and other Hindu forces from India have a provisional stay and a sub-ordinate role in Jammu and Kashmir. These forces have been granted admission to perform four duties and have been put under a United Nations caution on its number, behaviour and location. Evidence suggests that the basis of their admission has been vitiated and these Hindu forces have turned against the unarmed Muslim population of Kashmir. These forces have killed a generation of Kashmiri Muslims, enjoyed freedom to kill at will under the cover of AFSPA, are engaged in a massive violation of human rights and in dishonouring of Kashmiri women. The abuse of Muslims makes these Hindu forces an occupation force and the people of Kashmir reserve a right to undo this occupation by the use of a force.

 

Maulvi Mehbooba Indian forces in Kashmir have been called wicked forces in Resolution E/CN.4/Sub.2/1997/l.21 which was moved by Mme Palley British Expert at the 49th session of UN Sub Commission on Human Rights in August 1997. There are over 800,000 Indian forces, that is, Hindu troops controlling the Muslim population. Your government has issued 51,000arms licenses to equip Village Defence Committees, comprising of Hindu criminals in the last two years. It is to target Jammu, Udhampur, Muslim dominated Pirpanchal and Chenab valley region.

 

We have moved from Indian occupation to Hindu occupation. Militant attacks are not only a right but a natural reflex in a habitat which has been taken over by non-State Subjects, in particular, by ones who needed a permit to enter the State until 31 March 1959. It is a people occupied by another people. Militant attacks are not a setback to Islam and these don’t defame Jammu and Kashmir in any sense.

General Hasnain may be right in Indian sense that “Kashmiris are not really educated and are a century behind”. He may have a case to defend, only when he finds that elected people like you turn into a Maulvi and start issuing Sunday Fatwas against the interests of their own people. Kashmiri people have been recorded as, “a people of legend, song and story, associated with snow-capped mountains, beautiful Valleys and life giving waters”.

Dr. P. Graham adds in his report to UN Security Council, “The recognition of the rights and dignity, the security and the self-determination of these historic people, under the auspices of the United Nations, might well become a challenging example of the progressive values of self-determination to the dependant peoples of the earth. The people of Jammu and Kashmir through a free and impartial plebiscite would signal through the darkness of these times a ray of hope that not by bullets but by ballots, not through conflict of armies but through co-operation of peoples, is the enduring way of people to determine their destiny and way of life”.

First female Chief Minister of Jammu and Kashmir is under the caution of the United Nations, that is, the assembly which she represents is elected from only a part of the whole territory of the State of Jammu and Kashmir. It is not an inclusive and a representative government. There are two other Kashmiri governments at Muzaffarabad and Gilgit. As long as Indian forces continue to act as an occupation force and continue to refuse the people on the other side of cease fire line and the diaspora, their lawful entry and exit into the State, continues to impede the process to establish a Plebiscite administration and does not allow a UN supervised provisional government in the State, these forces shall continue to be a legitimate target

Any action’ militant or negotiated, in the defence of dignity and self-determination and other actions to undo an occupation are in no way a setback to Islam and these do not defame Jammu and Kashmir. Maulvi Mehbooba has misdirected herself.
